CMS clarifies interpretation of regulation 28 (7) and the finalisation of circular 35 of 2022.
On 29 May 2025, the Independent Financial Advisors Forum (IFAF) released a media statement indicating that the regulator may have lacked coherent enforcement powers to provide regulatory guidance on the interpretation of Regulation 28 (7) of the Medical Schemes Act including its inability to finalise Circular 25 of 2022.
While CMS respects the right of any entity to criticise the work of the regulator, we wish to however clarify any ambiguity related to the two matters raised by IFAF.
