Circular 25 of 2023: Amendments to the Medical Schemes Act Regulations 31 & 32
The Council for Medical Schemes (CMS) would like to notify stakeholders and the general public that the proposed amendments to Regulations 31 and 32 of the Medical Schemes Act (131 of 1998) (MSA) have been promulgated by the Minister of Health, Dr Joe Phaahla in Government Gazette Notice no 48838 published on 23 June 2023.
Regulation 31 deals with the fees payable to register a medical scheme, accredit an administrator, managed care organisation and brokers, and change the name of a medical scheme. It also states the amount payable upon the renewal of accreditation of entities. Regulation 32 deals with penalties payable for every day, a failure contemplated in Section 66(3) of the MSA continues.
The new rates are effective from 01 September 2023.
